Film Review: Resident Evil: Extinction

This newest addition to the growing RESIDENT EVIL franchise is a vast improvement over the previous installment in more ways then one. Although still written by series progenitor Paul W.S. Anderson, RESIDENT EVIL: EXTINCTION as directed by seasoned director Russell Mulcahy is a vastly different animal then the previous two films.

It is several years after the events of APOCALYSE and EXTINCTION finds Alice (Milla Jovovich) on her own in a barren wasteland of a world in which the T-Virus has turned much of the world into zombies and only the few patches of survivors scavenge the Earth for supplies. Alice has put herself into self exile when she realized her telekinetic powers are too strong for even her to command and that the Umbrella Corporation is constantly tracking her down and putting her life in danger. When Alice finds herself stranded after loosing her motorbike she hooks up with old pals Carlos (Oded Fehr) and L.J. (Mike Epps), who have linked up with Claire Redfield (Ali Larter) to protect her band of survivors at any cost. When Alice saves the survivors from being devoured by T-Virus infected crows her presence becomes known by Dr. Isaacs (Iain Glen) and the Umbrella Corp who secretly have been trying to develop a cure to the epidemic by creating clones of Alice; this has not worked for them and thus need the original Alice to find a cure.

Alice then suggests that they head north where there might still be a place on Earth not ravaged by the epidemic. In order to make the trip the caravan must first head to the city of sin Las Vegas for supplies but Dr. Isaacs has other plans as he sends his super-zombies to capture Alice and kill everyone else.

Very few horror films take place in broad daylight finding it easier to illicit scares in the dark but this film takes place almost entirely in the daylight and does an excellent job of creating suspense and horror. This film is a road movie in the tradition of THE ROAD WARRIOR and achieves both the scares and the unending action from start to finish. When the film enters the underground lair of the Umbrella Corp is where it falls apart as is apparent from all of the previous RESIDENT EVIL films. A mutated Dr. Isaacs makes for a poor villain like Nemesis in the previous film but the film needs an escalation of final villains. David Johnson’s cinematography is top notch as is Charlie Clouser’s score, which elevates the film making it one of the more interesting horror films of the year.

The Law for the Amendment of the Income Tax Ordinance (No. 132), 5762 – 2002, was passed on 24.07.2002. Its incidence is on revenue produced or grown starting with the year 2003 and on.

The essence of the reform is conversion from a tax method on a territorial basis, i.e. taxation of all revenues produced or grown solely in Israel, to taxation on a personal basis, i.e. taxing all the revenues of an Israeli resident, unrelated to the identity of the location in which the income was produced.

The result of the change in the tax method and the move to taxation on a personal basis is in practice, an expansion of the tax base in Israel.

Clearly, from the aforementioned, there is great importance to the examination of the question as to who is “An Israeli Resident”? The Income Tax ordinance defines an individual as an Israeli resident as one whose center of life is located in Israel. The definition of the center of life of an individual includes a material component, which examines the familiarity, economical and social affinities of the person. Based on this test, a person’s residency is determined according to the location, the majority of his examined affinities are pointing to (familiarity, economical, social etc.).

In practice, the test of the Center of Life was adopted from the adjudication and was fixed in the law under Amendment No. 132. The Gonen case is relevant in this matter; it determined that for the purpose of the implementation of the Center of Life Test an overall view and examination of all of the individual’s lifestyle is necessary (his family, the location of his economic interests, the location of his social contacts etc.), and in accordance with the totality of circumstances.

In this matter, the Court also determined that the Center of Life Test is twofold: One, the objective, the location of most of a person’s affinities (the physical examination), and the second, subjective, is where the person considers his Center of Life (the examination of intention).

It is important to state, that a person’s residency does not necessarily start or stop when he moved to live outside the borders of the country, and this is so even if the move is for several years. This means that the case is not one of “a sharp act” but rather a gradual process.

In order to complete the picture, it is advisable to mention the Zeiger judgment, where the question of splitting the family cell regarding the definition of the term “resident” is dealt with. On that issue, the assessed worked for many years in Eilat whereas his family moved, at a certain stage, to Raanana.

Indeed, the Court relates to the definition of the term “resident” for the purpose of the benefits under the Free Trade Law in Eilat, but for that purpose, it makes an inference from the definition of “resident” in the Ordinance.

On the issue of splitting the family cell, the Court determines that under special circumstances when an individual resides for many years abroad where he is “implanted” economically and socially, he can be seen as a foreign resident although his family cell is in Israel.

It is possible to fall into the frame of the status of “resident” without the material examination whether a person’s Center of Life is located in the country, including not examining the familiarity, economical and social affinities. For this purpose, the Ordinance determines two rebuttable presumptions:

The first alternative: According to the first alternative, it is sufficient for a person to stay in Israel for the majority of the days of the year, i.e. at least 183 days during a tax year (meaning a calendar year), for him to be considered a resident for taxation purposes. The basis for this presumption is that a person who spends most of the days during a certain tax year in Israel, his Center of Life during that tax year is in Israel.

The second alternative: According to the second alternative, if a person stayed in Israel, during the past three tax years (including the examined year) at least 425 days.
